Contribution Terms and Conditions
These Contribution Terms and Conditions apply to every online contribution made to Sajenn through www.sajenn.eu. On the aforementioned website, the contributer is asked to accept these Contribution Terms and Conditions by checking a box. Sajenn reserves the right to amend the Contribution Terms and Conditions at any time.
Article 1 – Definitions
In these Contribution Terms and Conditions, the following terms shall have the following meanings:
Services: The services offered by Sajenn, including:
– Providing access to the website
– Enabling contributions through a contribution button;
Contributor: Any individual or legal entity who wishes to make contributions to Sajenn by using Sajenn’s services;
Contribution: A monetary amount gifted by the contributor to Sajenn in accordance with these Contribution Terms and Conditions;
Contribution Platform: All software provided by Sajenn, whether via its website(s) or otherwise, enabling contributions, including Sajenn’s applications for websites, tablets, and smartphones;
Transaction: Any factual or legal act, statement, or behavior that creates an obligation, a right, or an agreement;
Agreement: The agreement between Sajenn and the contributor;
Mollie: (Collecting) Payment Service Provider. This is a payment service provider that offers Sajenn an automated and secure payment environment, where contributions are collected under their supervision and paid out to Sajenn.
Website: All websites managed and/or used by Sajenn, including www.sajenn.eu
Article 2 – Applicability
- These Contribution Terms and Conditions apply to the content, formation, and performance of all contribution transactions of Sajenn. Provisions, especially specific ones, deviating from these Contribution Terms and Conditions are only valid if confirmed in writing by Sajenn.
- By using the contribution button to make a contribution, the contributor declares that they are familiar with and agree to the content of these Contribution Terms and Conditions.
Article 3 – General
- The contributor has the option to make a one-time contribution of a predetermined or self-selected amount or choose a monthly or quarterly recurring fixed contribution, with the option to select the amount themselves.
- The contribution will be credited to Sajenn’s account. After the contribution is paid, the money legally belongs to Sajenn.
- If the contributor cannot agree to these Contribution Terms and Conditions, they should not use the contribution platform. If the contributor uses the contribution platform, they also agree to these Contribution Terms and Conditions.
Article 4 – Rights and Duties of Sajenn
- The contributor contributions to the Sajenn platform, whereby the platform receives contributions through Mollie. Sajenn ensures that contributions made through the contribution platform are used for the benefit of Sajenn’s objectives.
- Sajenn reserves the right to modify and/or expand its services and/or these Contribution Terms and Conditions.
- In the execution of this agreement, Sajenn may, at its discretion, involve third parties, provided that Sajenn ensures that these third parties are subject to the same contractual obligations regarding confidentiality and privacy as Sajenn itself.
- Sajenn may assign rights and obligations from the agreement to third parties.
- Refunds are not possible.
- Sajenn takes appropriate measures to secure the transfer of data in the context of this action.
- Persons authorized on behalf of Sajenn to access this data are obligated to maintain confidentiality, except for legally permitted exceptions.
Article 5 – Rights and Duties of the Contributor
- The contributor is aware that, by agreeing to these Contribution Terms and Conditions and making a contribution, the contribution is irrevocable, and they will not be able to receive the contribution back.
- The contributor cannot derive any rights from a contribution.
- The contributor declares to be at least 16 years old. By entering into an agreement, the contributor confirms compliance with this age requirement.
- The contributor ensures that the information provided by them (including personal data such as name and email address) is correct and complete when making a contribution to Sajenn.
- The contributor agrees to Sajenn’s Privacy Policy when making a contribution (https://sajenn.eu/privacy-policy-cookies-disclaimer/).
- The contributor makes contributions only with funds over which they have control and authority.
- The contributor agrees that when they deduct contributions from income tax, they are solely responsible for confirming that contributions made via Sajenn are tax-deductible and that Sajenn bears no liability for this.
Article 6 – Contributions
- Contributions are irrevocable and without immediate consideration.
- To make a contribution, the contributor must independently complete all steps of the contribution process and all steps of the payment process successfully.
- The contributor is responsible for filling in all data and determines the amount and frequency of the contribution.
- Sajenn reserves the right to refuse a contribution without giving a reason. In this case, the contribution will be refunded to the account from which the contribution originated.
- Sajenn is not liable for any errors and/or malfunctions that occur during the transfer of funds. In case of errors and/or malfunctions, the contributor should contact their bank.
- The contributor can contribute as often as they wish. For each contribution, it is necessary to select the amount again, accept the Contribution Terms and Conditions, and make the payment.
- Contributions will be transferred via the payment program to Sajenn’s account.
- Upon cancellation of a recurring contribution, the contributor has the right to stop the monthly or quarterly contribution, with a notice period of the current month. Refund on the contribution amount for the current month is not possible. If the contributor wishes to stop the contribution, they should contact Sajenn via the contact form.
Article 7 – Websites
- Sajenn has compiled the content of the website(s) with the utmost care. However, the information displayed on the website(s) may also include information from various sources and originate from third parties.
- The website may contain references (e.g., through a hyperlink, banner, or button) to third-party websites. When Sajenn offers links to beneficiary information, this does not mean that Sajenn endorses the offered information or services. Sajenn has no control over the content of these websites. Sajenn is not responsible for the content of these websites. The use of such links is entirely at the contributor’s risk.
- Sajenn reasonably endeavors to secure its system against loss and/or any form of unlawful use. Sajenn implements appropriate technical and organizational measures, taking into account the state of the art. Sajenn is not liable for any damage on the contributor’s or third parties’ side resulting from insufficient security.
- Sajenn aims to keep the website(s) and the online contribution module continuously online but does not provide any guarantee for this. Sajenn is authorized to temporarily take the website(s) out of service or limit its functionality, for example, if necessary for maintenance or adjustments to the website(s), without creating any right to compensation for damages against Sajenn.
- The contributor is responsible for using the website(s). The use of the website(s) is entirely at the contributor’s risk. Therefore, Sajenn does not guarantee that its website’s content will always be fully available, accurate, complete, and up-to-date. Sajenn also does not guarantee that the website(s) will work uninterrupted, be free from viruses, trojans, and other errors and/or defects, and that defects can be corrected, nor that third parties will not use its systems unlawfully.
Article 8 – Personal Data
- Sajenn, or its affiliated and/or cooperating companies and/or organizations, use these personal data for the purposes described in the following article (data processing).
- Sajenn respects the contributor’s privacy and ensures that the personal information provided to Sajenn is treated confidentially. Processing of personal data is carried out in a manner consistent with the requirements outlined in the privacy policy (https://sajenn.eu/privacy-policy-cookies-disclaimer/).
- Third-party systems not owned by Sajenn are included on the website(s) and/or contribution platform. Although these third parties have been carefully selected, Sajenn does not take responsibility for these third parties and how they handle the contributor’s data.
Article 9 – Data Processing
- The data entered by the contributor on the website(s) or the contribution platform during the contribution process are processed by Sajenn or through third parties with which the contributor registers (such as Facebook or Twitter).
- The contributor’s personal data are processed by Sajenn to:
- A) Enable the contribution platform to function;
- B) Send newsletters informing the contributor about news related to the beneficiary, Sajenn’s services, and related matters. Each newsletter contains a link through which the contributor can unsubscribe;
- C) Use them for marketing or promotional purposes related to Sajenn’s services in any form;
- D) Compile anonymized statistical data;
- E) Secure the contribution platform;
- F) Compile anonymized user statistics. Third parties that compile user statistics for Sajenn and conduct web analyses may have access to automatically generated information, including the contributor’s IP address.
Article 10 – Liability
- Sajenn and/or third parties are not liable for any damage, direct and/or indirect, arising from or in any way related to a contribution. No rights can be derived from making a contribution.
Article 11 – Applicable Law and Disputes
- These Contribution Terms and Conditons are governed by Dutch law.
- All disputes between the parties, including those considered as such by only one of the parties, shall be settled by the competent court in the place where Sajenn is established, currently being Eindhoven. Nevertheless, Sajenn reserves the right to choose the legally or conventionally competent court.
- If any provision mentioned in these Contribution Terms and Conditons, applicable to the contributor, is declared void, this provision shall be replaced by a valid provision that corresponds as much as possible to the same purport. The validity of the other provisions of these Contribution Terms and Conditons remains unchanged.
Article 12 – Intellectual Property Rights
- All intellectual property rights regarding the content and layout of the website(s) and the contribution platform belong to Sajenn. Copying, distributing, and any other use of these materials is not allowed without explicit written permission from Sajenn, except and only to the extent otherwise provided by mandatory legislation.
- It is not allowed to include web pages or individual elements (such as images, videos, or interactive applications) of the website(s) and/or the contribution platform in a frameset or process them via another web page without clearly indicating the origin of the material.
- Sajenn does not transfer any intellectual property rights and/or grant any intellectual property rights to the contributor.
- The contributor acknowledges and agrees that the contribution platform contains files, other content, and programs owned by Sajenn and/or third parties, protected by applicable intellectual property rights, including but not limited to copyrights, database rights, neighboring rights, trademark rights, and patents.
- It is expressly not allowed to download, copy, modify, disclose, use for direct or indirect commercial purposes, or use for any other purpose than the purposes mentioned above, files, data, programs, and/or materials without explicit written permission from Sajenn.
- It is not allowed to remove, make illegible, hide, or modify notices or indications regarding intellectual property rights.
